Amazon Global Store Terms and Conditions

Last updated 1 November 2016.

Welcome to the Amazon Global Store. Products in the Amazon Global Store ("Amazon Global Store Products") are sold and shipped by Amazon Export Sales, LLC, a U.S. company ("Amazon US"). By placing an order for any Amazon Global Store Product(s), you agree to these Amazon Global Store Terms and Conditions (these "Terms and Conditions").

Ordering from the U.S.; Applicable Law and Venue

When purchasing Amazon Global Store Products, you acknowledge that (1) you are ordering from Amazon US, equivalent to making a purchase from the Amazon.com website, (2) these products have not yet been imported into the UK at the time of purchase, and (3) that the sale takes place in the U.S.; therefore, subject to the laws and regulations of the U.S. In addition to these Terms and Conditions, the Conditions of Use from Amazon.com will also apply. In particular, you agree that the applicable law and venue as set out in those Conditions of Use will apply, waiving (to the extent permitted by law) any other jurisdiction that may apply for any reason. The application of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded. This clause is without prejudice to your rights to enforce your consumer protection rights in connection with these Terms & Conditions in any other EU country in which you live.

If any provision of these Terms and Conditions conflicts with the Amazon.com Conditions of Use or the Amazon.co.uk Conditions of Use & Sale, the conflict shall be resolved in the following order of priority: (1) these Terms and Conditions, (2) the Amazon.com Conditions of Use, and (3) the Amazon.co.uk Conditions of Use & Sale.

Responsibility for Importation

When ordering Amazon Global Store Products on Amazon.co.uk, you are responsible for lawfully importing the product into the UK and act as the declarant for customs purposes into the UK. The risk of loss and title for Amazon Global Store Products that you purchase pass to you upon our delivery to the carrier. You may be subject to taxes and fees levied by UK customs and tax authorities ("Import Tax and Fees"), which are triggered when a shipment is imported into the UK. Please see below for more details regarding Import Tax and Fees. You agree that you will be the final consumer of the product or that you will be giving the product to another individual as a gift, and in any case that the product is being purchased for personal use only and not for resale or for any commercial use.

Import Tax and Fees

As imported products, Amazon Global Store Products may be subject to Import Tax and Fees. As the declarant, you are solely responsible for paying these taxes and fees. We will estimate the amount of Import Tax and Fees (the "Estimated Import Tax and Fees") for Amazon Global Store Products and charge them to you when you place an order. For each Amazon Global Store Product on which the Estimated Import Tax and Fees are charged, you authorise Amazon US to designate a carrier ("Designated Carrier") to act as your agent with the relevant customs and tax authorities, to carry out the customs clearance for the merchandise, process and pay the Actual Import Tax and Fees for such items.

The Estimated Import Tax and Fees may not be the same as the actual amount paid to the relevant UK authorities (the "Actual Import Tax and Fees"). Customs regulations and tax rates applicable to certain goods may change between the date the taxes and duties were estimated and the applicable taxes and duties on the date of import into the UK. The duty or tax rate is determined by the classification of a good and the total value of your imported products. The Estimated Import Tax and Fees will be used, on your behalf, to reimburse the Designated Carriers for the Actual Import Tax and Fees that they have paid on your behalf to the appropriate authorities. You further agree that the Designated Carrier or other agent may disclose to Amazon US the Actual Import Tax and Fees along with any other information that Amazon requests to validate the payment of the Actual Import Tax and Fees.

If the Actual Import Tax and Fees are less than the Estimated Import Tax and Fees, you'll automatically be refunded the difference. You'll receive a notification e-mail confirming the amount of the refund. The process takes approximately 60 days from the date on which the customs clearance completes for you to receive any refunded amount. If the Actual Import Tax and Fees are more than the Estimated Import Tax and Fees, you will not be charged any additional amounts. To obtain details regarding the Actual Import Fees, or to obtain documentation or receipts in connection with customs clearance, you may contact the Designated Carrier specified in your shipment confirmation e-mail.

Warranties for Amazon Global Store Products

For Amazon Global Store Products, warranties and other after sale services provided by the manufacturers may not apply outside the U.S. To receive warranty service, you may be required to return products to the authorised manufacturer representatives in the U.S.

Returns, Refunds, and Title

Amazon US does not take title to returned items until the item arrives at our fulfillment centre. At our discretion, Amazon US may elect to issue a refund without requiring a return or taking title to the refunded item.

Product Descriptions and Pricing

Amazon US attempts to be as accurate as possible in describing the Amazon Global Store Products. However, Amazon US does not warrant that Amazon Global Store Product descriptions are accurate, complete, reliable, current, or error-free. If a product offered by Amazon US is not as described, your sole remedy is to return it for a refund.

With respect to items sold by Amazon US, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items we offer may be mispriced. If the correct price of an item sold by Amazon US is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

Liability

TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, AMAZON US DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. AMAZON US WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.

Privacy

You acknowledge and agree that information related to your Amazon Global Store Product purchases may be shared with Amazon US who will store and use such information in accordance with the Amazon.com Privacy Notice.

Your privacy is important to us, and we know that you care about how information about your order is used and shared. We would like our customers to be aware that cross-border shipments are subject to opening and inspection by customs and/or postal authorities.

Also, we may provide certain order, shipment, and product information, such as product names or titles, to our international carriers or agents, and such information may be communicated by the carriers or agents to customs and/or postal authorities in order to facilitate customs clearance and comply with local laws.
