So in that sense you CAN effectively transfer them - just not by copying the files directly from one to the other.

It depends on which was your old Kindle and which will be your new Kindle and which books you have bought.

95% or more of books from Amazon can be read on all Kindles. But there is that 5% that can only be read on tablet or PC devices. You can always install Kindle for PC (or the Windows 8 Kindle app) and register that to your account as well as any Kindles and read your books on that device.

Any books obtained from elsewhere [and not stored in the Amazon cloud] can not be re-downloaded from Amazon. These other books you will need to arrange your own backup (a PC and a backup of that by copying to a DVD or USB drive). You should (as long as they are not DRM protected which would be unusual) be able to just re-copy these from your own backup to the new Kindle.
