THE AUTHORITATIVE WORK OF REFERENCE ON STATUTORY NUISANCE

An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers

What is a nuisance? What isn't a nuisance? As illustrated graphically on the cover of this now well established and definitive guide to the subject, there are plenty of nuisances around as we all know. From howling dogs to killer-driller roadworks operatives, nuisances can be the bane of urban life in particular.

But however nuisance is defined, where does the law stand on it and related issues? Now in a new third edition from Bloomsbury Professional, `Statutory Nuisance' provides what has become the definitive and authoritative guide to this complex and often vexed area of law.

As Lindblom J notes in the foreword, `the law in this field has become complex, at least in its application.' If you're involved with, or concerned in any capacity with nuisance, you would do well to acquire this book. Not only is it a user-friendly guide to the subject; it also provides the primary materials needed in court.

`A book with practical considerations at its heart,' says Lindblom in the foreword, adding that `judges have found this book useful and have cited the views expressed in its two earlier editions.'

What is also noteworthy about this book is that it airs a number of views on a number of issues which the courts have apparently not yet resolved. `The essential foundation of the law of nuisance', as the authors, McCracken, Jones and Pereira, note in the Preface, `is good neighbourliness'- the importance of which was recently cited by Her Majesty The Queen in her Diamond Jubilee message.

This new edition of `Statutory Nuisance' presents and examines lucidly, and in depth, all recent relevant case law and legislation pertaining to nuisance, including the Equality Act 2010... Criminal Procedure Rules 2011... recent Court of Appeal decisions... new civil procedures for abatement notice appeals... and of course much more.

As nuisance can and does impact severely on everyday life, this practical and clearly written work of reference will be of interest not merely to legal practitioners, but to the wider public - as well as professionals in other fields, such as, for example, local government environmental health officers, community groups, CAB officials and their legal advisers.

Within its more than 700 pages, the book is also a treasure trove of avenues for further research, including tables of statutes, statutory instruments and cases. There are no less than nine appendices, some containing further bibliographies and glossaries, plus a detailed index at the back.

Appendix I is `a list of useful links'. Useful! We would say indispensable, as is the book itself. The publication date is stated as at St George's Day 2012.
