Product Description

Review

Property Law by Smith is a highly regarded text (and) has been updated to include material such as the proposals from the Law Commission, case law and legislation. The material is relatively easy to read and quite detailed which allows the student to obtain a good understanding of the material covered. The footnotes also contain references to articles which gives the student a starting point for research.... ...In conclusion, this text is an extremely useful academic text and a student could do no worse than purchase this text.  Student Law Journal, Hull --This text refers to an alternate Paperback edition.

From the Back Cover

Property Law: Cases and Materials provides a comprehensive sourcebook for students on property law or land law courses.  The source material has been carefully selected to include all the cases and materials a property law student is likely to encounter in a study of the subject.  While particularly suitable for property law and land law courses on the LL.B., the book also covers the requirements of the CPE, ILEX and combined law courses.

This fourth edition has been fully updated according to recent developments in the law:

  • Human Rights have attracted much attention, with decisions of the European Court of Human Rights in JA Pye (Oxford) Ltdv United Kingdomand McCann v United Kingdom and of the House of Lords inDoherty v Birmingham City Council;
  • Ownership of the family home featured in Stack v Dowden, a very important House of Lords decision, and a Law Commission report;
  • The basis for proving estoppel was reviewed in Cobbev Yeoman’s Row Management Ltd;
  • Easements drew the attention of the House of Lords in Moncrieff v Jamieson (rights to park cars) and (together with freehold covenants) the Law Commission.

Key features:

  • Wide range of extracts, including cases, legislation, academic literature and law commission reports, purposely chosen to highlight key principles in property law
  • Commentary and reflection questions draw together themes and provoke critical thinking about the extracts, highlighting controversies surrounding legal principles and encouraging students to actively engage with the material
  • Designed to be used as a companion to the author’s own textbook, Property Law, sixth edition, and can also be used alongside any textbook on property or land law

this book is thoroughly readable and enjoyable. as this part of a law course is usually for first time legal students the book written in a way not to confuse you and keep you interested in the ways of the legal system. informative, and thorough this was the only text book I used in the first year for my property module.

We use this at Oxford for the Land Law course. It is utter pants if you're just starting out and want to know what the hell is going on, but once you have a grasp of the basics, it is good for further reflection and nitty-gritty analysis.

I think the fact that it is prescribed for the Oxford law course says it all - not for simple introductory courses! If you're looking for a superficial analysis, buy nutcases or a casebook. If you're looking for first rate analysis from one of the UK's leading authorities on land law, then this is the book.

Thought provoking and thorough, some say it's like Oxford tutorials but in a book.

This book was provided to me on my distance learning LL.B (Hons) degree for the Property/land element of this year. I can honestly say, I'd be lost without Roger Smiths' Property Law - Cases and Materials. This book is not designed for the light-hearted. If you want the bear-bones, I would recommend Nutshells, LawExpress or Key Facts and Cases. Smith provide a detailed insight into the ever confusing world of land land and if you have that extra 10 minutes to read the comments and attempt the probing questions, it is well worth your extra time. The only constructive comment is that Smith omits to use basic features, such as bold and italics to really highly the conflicting areas and complex areas of this subject, otherwise, a must for any law student.
