'Smartware' = unusable, HD failed after 1 year,

I was sold by the pretty packaging and a personal reccommendation from a friend who said that Western Digital make good drives...
Disappointment set in straight away, when I spent a grueling few hours trying to work out the mysterious 'SmartWare' (I am very computer literate as well), which sounded great (automated back-ups)... when I finally set it to back up a select few folders, it predicted a time of 36hours to back up 250gb of data. This was not acceptable so I gave up and deleted the Smartware and just used it as a normal drag-drop drive. This worked fine and was reasonably fast. Only annoyance being the virtual 'CDROM drive' that pops up everytime you plug it in.
I used it regularly as a neatly portable drive to swap files between computers and back stuff up. Then suddenly, in February 2011 after exactly 1 year, it suddenly does not show up at all anywhere on the system, on any computer. The drive is spinning so it clearly knows it is plugged in but the computer will not show it. When I fiddle with the USB cable it suddenly pops in for a a few seconds stating 'Drive Failure - Drive H must be formated before continuing, OK - CANCEL?'.
I see that many many users have had similar issues after a few months of usage (look on forums and on here). It also seems WD are not easy to get hold of and are not paying for data recovery.
