USED IN THE MOST EFFICIENT AND, CRUCIALLY, EFFECTIVE WAY

The second edition of this APIL/Jordans venture provides all claimant personal injury lawyers with a fully comprehensive and time-saving collection of pleadings and applications relevant to the types of court order you would wish to seek. We particularly liked the new sections on skeleton arguments (with the skeleton being just that... a skeleton!) and the CD ROM to go with the book is a boon for the busy practitioner and very handy to use.

The first edition appeared in 2007 and, five years on, this new edition fulfills its aim to guide readers towards using pleadings and applications in the most efficient and effective way. You do have a comprehensive, time-saving collection of pleadings, applications and court orders in one place without having to carry many heavy books around.

The three authors, Martin Bare, Leila Benyounes and Richard Copnall, together with additional contributions from Andrew Axon and Dominic Hughes have fully updated the first edition and now include sections on the following: clinical negligence; holiday claims; skeleton arguments and PI claims in contract; recent decisions on the Animals Act and vicarious liability; mesothelioma; RTA claims processes, the Third Parties (Rights Against Insurers) Act 2010; and insolvency provisions of the Companies Act 2006.

We do applaud the sentiments in the Preface where the authors say: "To those brought up in the tradition of `prayers', `aforesaids' and `thunderbuss' particulars, our approach to pleadings will be a revelation." Stand by for the revelation! And it is very welcome to the Bar and the Bench.

They have deliberately (and rightly) removed legalese and verbiage to create an approach which is both clear and concise, and to repeat their words "efficient and, above all, effective".

Whilst many areas of personal injury law are complex, always remember that the variety of factual situations is limitless (that is why we have so much court work!) so each precedent must be carefully tailored to the circumstances of a specific case.

It is the adaptation which remains the key and the work put in by these three expert authors, Bare, Benyounes and Copnall and their colleagues is most gratefully received for those who want their pleadings to reflect the way we practice in the 21st century.

This is a very good book and the CD is very useful.

It contains many practical applications and pleadings.

Some of the pleadings may be irrelevant to the type of work you specialise

in but it is still an excellent point of reference.

There are some applications I expected to see in there but they were not there (

ie application to enter Judgment on a Part 36 acceptance were no payment made;

application for Unless Order and a bit more detail on this area etc etc)

this is the only reason it gets a 4/5 and not 5.
