Amazon Prime Terms & Conditions
Last updated October 25, 2012
Welcome to the terms and conditions ("Terms") for Amazon Prime. These Terms are between you and Amazon.co.uk (Amazon.co.uk is the trading name for Amazon EU Sàrl) and/or its affiliates ("Amazon.co.uk" or "us") and they govern our respective rights and obligations. The Terms, together with applicable terms and conditions related to any promotional offers provided to you for use with Amazon Prime, constitute the entire agreement between you and Amazon.co.uk related to your Amazon Prime membership. Please note that your use of the Amazon.co.uk website, located at www.amazon.co.uk, and any successor or replacement website (the "Amazon.co.uk Website") and an Amazon Prime membership are also governed by our Conditions of Use & Sale and Privacy Notice, as well as all other applicable terms, conditions, limitations and requirements on the Amazon.co.uk Website, all of which (as changed over time) are incorporated into these Terms. If you register for an Amazon Prime membership, you accept these terms, conditions, limitations and requirements. Please read these Terms carefully.
Amazon Prime members are entitled to discounted delivery benefits on selected delivery options (where available) such as First Class, One-Day, Expedited, Express and Evening delivery. Selected delivery options usually apply across business days which include Saturdays, unless otherwise specified. Availability of delivery benefits depends on inventory availability, order deadlines and in some cases on the delivery address. If you purchase an Amazon Prime membership, you may also invite up to four eligible family members living in your household (at the same address) as registered guests to enjoy your Amazon Prime membership at no extra cost. Your naming of an individual as a registered guest constitutes your agreement that they may use services under your Amazon Prime membership. Please note that any registered guest under age 18 may use the Amazon.co.uk Website only with involvement of a parent or guardian. The Amazon Prime member can change and/or remove registered guests at any time. A registered guest's use of Amazon Prime benefits will automatically terminate if the owner of the Amazon Prime membership ceases to be a member or removes the registered guest. An Amazon Prime membership is only available to end consumers aged 18 years or older using Amazon Prime for private use and is not available for Corporate Accounts, legal entities or for customers who purchase items for business or institutional use or for the purpose of resale.
Kindle Owners Lending Library
Paid and free trial members who own a Kindle device also receive access to the Kindle Owners' Lending Library. Kindle Owners' Lending Library is not available to Amazon Prime registered guests and Amazon Family members receiving free Amazon Prime shipping benefits. We may remove access to the Kindle Owners' Lending Library as Amazon Prime benefits at any time
Prime delivery benefits are limited to certain products sold by Amazon or third party merchants participating in the Fulfillment by Amazon programme, on the Amazon.co.uk Website. Products eligible for Amazon Prime will be designated as such on their product detail page. Addresses eligible for First Class, One-Day, Expedited, Express and Evening delivery are specified in their respective terms and conditions. From time to time, we may exclude items in our discretion, including, for example, oversize or heavy items, items regulated as hazardous materials and other items with special delivery characteristics. Such items will not be marked as eligible and therefore will not qualify for Amazon Prime. Items sold by third parties or through third-party areas such as Marketplace are NOT eligible for Amazon Prime unless indicated otherwise.
You must have an Amazon.co.uk account to sign up for and use Amazon Prime. We reserve the right to accept or refuse membership in our discretion. Your membership contract with us will be concluded once you receive email confirmation of your Amazon Prime membership. You may not transfer or assign your membership or these benefits, except as part of our registered guest programme described above. Handling fees and/or taxes may still apply to eligible purchases of special items or orders, which will be pointed out in the relevant offer. If only some items in your order are eligible for Amazon Prime, you will pay applicable delivery charges for the ineligible items. In general, changing or combining orders or changing your delivery address, speed or preferences might affect Amazon Prime eligibility. Please note:
The annual membership fee for Amazon Prime is stated in the Amazon Prime section of our Help pages. This fee is non-refundable except as expressly set forth below. You can always request a refund of the most recent charge if your benefits haven't been used in the new term. You can use Your Account to update your preferred payment method for all fees for this subscription.
AT THE END OF THE FIRST AND ANY FOLLOWING MEMBERSHIP YEAR, YOUR MEMBERSHIP WILL RENEW AUTOMATICALLY FOR ANOTHER YEAR. UNLESS YOU NOTIFY US BEFORE RENEWAL THAT YOU WANT TO CANCEL OR DO NOT WANT TO AUTOMATICALLY RENEW (BY SETTING YOUR ACCOUNT TO "DO NOT AUTO RENEW"), YOU UNDERSTAND YOUR MEMBERSHIP WILL AUTOMATICALLY RENEW AND YOU AUTHORISE US (WITHOUT FURTHER NOTICE TO YOU) TO COLLECT THE THEN-APPLICABLE ANNUAL MEMBERSHIP FEE USING ANY PAYMENT CARD WE HAVE ON RECORD FOR YOU.
If all credit cards we have on file for you are declined for payment of your membership fee, you have 30 days to provide us a new credit card or your membership will be cancelled. If you provide us with a new card and are successfully charged within 30 days, your new membership period will be based on the original renewal date and not the date of the successful charge.
You can cancel your membership in Your Account at any time before you or your registered guests have made any eligible purchases and we will refund your full membership fee.
Promotion Trial Membership
We sometimes offer customers various trial or other promotional memberships, which are subject to these Terms except as otherwise stated in the promotional offers. Trial members can at any time (through Your Account) choose not to continue to paid annual membership at the end of the trial period.
Changes to Terms & Conditions
We reserve the right to make changes to these Terms, the Amazon Prime service, our Conditions of Use & Sale, our Privacy Notice or any aspect of the Amazon Prime membership from time to time by posting revisions on the Amazon.co.uk Website. YOUR CONTINUED MEMBERSHIP AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP. However, any increase in the membership fee will not apply until your membership is renewed. If any change is found invalid, void or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions.
Termination by Us
We may terminate your Amazon Prime membership at our discretion without notice. If we do so, we will give you a pro-rated refund of your membership fee. However, we will not give any refund for termination related to conduct that we determine, in our discretion, violates these Terms or any applicable law, involves fraud or misuse of Amazon Prime or is harmful to our interests or another user. Our failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights.
Amazon.co.uk will be responsible for any losses you suffer as a result of us breaching these Terms if the losses were reasonably foreseeable to both you and to us when you joined Amazon Prime. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) nor will we be responsible for any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you joined Amazon Prime. Amazon.co.uk does not limit in any way our liability by law for death or personal injury caused from our negligence or breach of duty or caused by our gross negligence or willful misconduct. Subject to the proceeding sentence, our maximum liability to you will not exceed the last annual membership fee you paid.
Events Beyond our Reasonable Control
We will not be held responsible for any delay or failure to comply with our obligations under these Terms if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
