I've loved 'The Highwayman', by Alfred Noyes, since I was a child, and have spent the last few years working on a supernatural story that makes reference to it.
For a long time, I thought it would be a story for my own personal enjoyment, until I found the multitude of 'Pride and Prejudice' variations.

So, my question is: when you write something based off/making reference to the published work of another author, are there legal issues that stop you from publishing it yourself? Do you have to ask the estate, or something?
