Excellent insight as to how a person's mental capacity is assessed by both the legal and medical profession. Provides both legal points with relevant case law and a complete insight as to how the medical profession would assess mental capacity. For would be litigants it also provides a thorough insight into what the Court would seek in terms of evidence relating to mental capacity and the definition of mental illness under the Mental Health Act 1983. The responsiblity for assessing a person's mental capacity is a grey area but this book provides readers with the knowledge of who would owe such a person a responsibility and how they would carry out those duties
