Product Description

Review
Clear and concise, the book will be useful to newcomers, while the depth with which the subject is treated will make it invaluable to experienced practitioners. As head of e-commerce at Field Fisher Waterhouse, and e-commerce Counsel for Enformatica Ltd, respectively, Michael Chissick and Alistair Kelman are excellently placed to provide authoritative guidance and comment as e-commerce unleashes itself globally. Clear and concise, the book will be useful to newcomers, while the depth with which the subject is treated will make it invaluable to experienced practitioners. This edition examines the most effective business structure for establishing an e-commerce service. Its chapters cover: online contracts; intellectual property rights; electronic payment systems; security; data protection; financial services; advertising on the Web; Internet taxation; and UK and European Legislation. The book is an indispensable companion to those seeking both to advise upon, and engage in, e-commerce.E-commerce and intellectual property rights are covered; the book has a code of practice for Web traders.Chissick and Kelman's book also ranges widely, covering establishment of an e-commerce business, contracting , conflicts, intellectual property, e-payment, evidence and security, privacy, financial services, advertising, tax, and European legislation. It appears to be aimed principally at practising lawyers and Internet-related businesses. As with the first edition, Chissick and Kelman make good use of illustrative examples to elucidate the difficult rules they consider. The book is generally balanced, well-written and entirely thorough. This European-orientated reviewer wondered whether a more central place might not have been given to the role of the EU, a regulator of seeming ever-increasing importance. Part of the final paragraph of the book reads, 'by postponing the promised e-commerce legislation until the new millennium the [UK] Government lost the opportuntiy of setting the agenda for the shole of Europe and must now follow what its European masters dctate' (p.287). This reviewer felt that this indicated an unrealistic view of the UK's role in Europe. However, the issue is clearly one on which differences of opinion can legitimately be held, and no doubt one ripe for future debate.Electronic Commerce: Law and Practice is a very well researched and clearly written source of information, which will provide assurance to e-commerce lawyers and will help other commercial lawyers understand the complex issues involved in doing business in cyberspaceAn indispensable companion to those seeking both to advise upon, and engage in, e-commerceThis is one of the most authoritative practitioner publications on Internet and e-commerce law.
