The Mental capacity Act 2005 provides a statutory framework for people who lack the capacity to make decisions for themselves, or for people who want to make provision for a time when they will be unable to make their own decisions. This code of practice, which has statutory force, provides information and guidance about how the Act should work in practice. It explains the principles behind the Act, defines when someone is incapable of making their own decisions and explains what is meant by acting in someone's best interests. It describes the role of the new Court of Protection and the role of Independent Mental Capacity Advocates and sets out the role of the Public Guardian. It also covers medical treatment and the way disputes can be resolved.

Like all HMSO publications this can be downloaded, legitimately and free from the government's own websites.

As a matter of note, the Code is workable, but noticably doesn't make any comment about the Bournewood provisions, probably the most complex part of the act (as ammended by the MHA 2007). the code as it stands promises this in future incarnations, and indeed the code of practice for the new MHA does address this to an extent.

So, here is a coherent, but incomplete, glossy magazine, that is for sale at almost £15, but can be downloaded as a pdf for free. Should you buy it? well, it would be an irrational choice, but one you are quite free to make! Myself, I'd save paper, post and money, and instead buy Richard Jones' MHAManual.

A very easy read for a code of practice, relating to a new law.You don't need the Act just this book.
It could have been improved by an index

One of the few remaining places where you can still obtain a written copy of the guide to the MCA rather than downloading it. A reasonably easy read, although rather a lot of it
