Product Description

Product Description

The purpose of this book is to provide easy access to a collection of essential source materials in order to simplify the principles of trust law and stimulate critical thought. The bulk of the material is selected from the conventional legal sources such as statutes and judicial decisions but some of the materials are drawn from articles and official reports.

From the Back Cover

This new edition has been considerably revised to take account of recent major statutory and case law developments. The Contracts (Rights of Third Parties) Act 1999 introduced a significant improvement in the rights of third parties to enforce contracts. The Trustee Delegation Act 1999 and the Trustee Act 2000 have had a profound effect in updating the law concerning trustees' duties and powers.

Important new cases covered include: Foskett v Mckeown (tracing); Pragon Finance Ltd v Thakerar (constructive trusts); Air Jamaica v Charlton (resulting trusts); Choithram International v Pagarani (constitution of trusts); Twinsectra Ltd v Yardley (accessory liability); Wight v Olswang (exclusion clauses); Southwood v AG (charities); Schmidt v Rosewood Trust (disclosure of trust documents); Pennington v Waine (gifts of shares); Le Foe v Le Foe (indirect contributions to family assets); Gwembe Valley Development Co Ltd v Koshy (limitation periods); Duggan v Governor of Full Sutton Prison (intention to create a trust); OT Computers Ltd v First National Tricity Finance Ltd (certainty of objects), and many more.

Each chapter includes an exposition of the fundamental principles of trusts law in a readable and intelligible form, supplemented by extracts from judgments of leading cases. References to other relevant cases, statutes, articles and official reports are incorporated where appropriate.

An excellent book!!! 14 Sep 2008
Format:Paperback
It is an excellent book. I found it very helpful for my tutorial preparation, writing course works and final exams. It contains all most important cases for this subject, gives facts on the cases and the most important extracts from judgements (it saved my time when I needed to find a particular phrase of Lord Denning or Lord Browne-Wilkinson, for example). Additionally, the book gives short introductions on each topic in the beginning of every section.
Of course, the book does include the cases only up to 2005, therefore, for more recent case law you should consult other sources of information.(Although you will not have to do it that often, as the majority of tests were established by 2004).

Format:Paperback
Starting with the essential concepts of a trust, this book goes on to explain in a lucid and comprehensive way the substantial areas of trust law. The book will be of use not only to students on undergraduate and CPE courses but also to those studying the BVC or LPC. Given the book is up-to-date, practitioners in this area should also consider purchasing the text.
